Filipino Visa Terms and Conditions of Service

Welcome to Filipino Visa, operated by Together Light Inc. These Terms of Service govern your use of our website and services. 

 

  1. Acceptance of Terms: By accessing or using our website, you agree to these Terms of Use and Privacy Policy. If you do not agree to all of these terms, do not use our website. 

  2. Use of our Website
    1. Our website and agents provide only general information and resources related to immigration, travel, and document preparation. The information provided is for general informational purposes only, and should not be considered legal advice. 
    2. You agree not to use our website or our services for any unlawful purpose or in any way that could damage, overburden, or impair our website. 


  3. Warnings and Disclaimer:
    1. Filipino Visa is not associated, affiliated with, or endorsed by any US governmental or immigration authority, including but not limited to the United States Citizenship and Immigration Services (USCIS). 
    2. All US immigration forms are available freely on the USCIS website. You do not need FilipinoVisa’s services to complete and file these forms. 
    3. FilipinoVisa is not a law firm, and any recommendation made by our agents or representatives is not a substitute for legal advice.
    4. FilipinoVisa is owned and managed by non-lawyers who are not subject to the same rules and regulations as licensed lawyers.
    5. By signing a contract with us, you agree that you are not signing an attorney-client contract, and the contract does not create an attorney-client relationship between you and Filipino Visa.
    6. You agree that you have had the opportunity to consult with an attorney about these terms of service, and either you have done so, or you waive your right to consult with an attorney about these terms of service.
    7. The issuance of a visa depends exclusively on the issuing authority. Immigration officials in each country have final authority to admit entry into the country or region, even when all of the stipulated requirements have been met. FilipinoVisa does not guarantee that any issuing authority will issue any visa, or that it will act on any time frame. 
    8. FilipinoVisa cannot guarantee immigration clearance from any port of entry/exit even after a visa has been issued by a government entity.  
    9. We provide consultation and documentation preparation assistance services on an ‘as is’ basis and grant no warranties of any kind, express or implied, statutory, or during any communication with our representatives. 
    10. We specifically do not provide legal advice or legal representation of any kind.


  4. Service Fees:
    1. When you sign a contract with us for our service(s), we charge fees for consultation, ground assistance, document preparation, and review. These fees are entirely separate from the immigration/government fees you pay to the immigration authorities (USCIS, etc.)
    2. Unless we indicate otherwise, you remain responsible for paying immigration/government fees for any visa application you apply for. 
    3. Government/immigration authorities change their fees from time to time. Therefore, the government fees to be paid at the time of filing your visa application could be different from the government fees estimated to you at the time of purchase of our service(s). 


  5. Term: These Terms of Service shall remain in full force and effect while you use our services; unless the services have been terminated by you or us, or your visa application process has been completed, and you have not consented to sign up for any additional service(s) from us.

  6. Termination:
    1. You may terminate the use of our services by sending us a written notice by email at: info@filipinovisa.com. We will determine whether you are eligible for a refund based on our Refund Policy
    2. If you violate these Terms of Service, you will not be entitled to any refund of the fees you paid.
    3. FilipinoVisa may terminate its service to you under these Terms of Service or its contract with you at any time, with or without notice, at its discretion, if you breach these Terms of Service or the contract you sign with us.


  7. Representations and Warranties:
    1. You represent and warrant to us that the information you send us is accurate, complete, and has not been misrepresented, copied, or fraudulently created or obtained by you or any third party.
    2. You also represent and warrant that any documentation you provide to us related to age, date of birth, travel, etc. are accurate and complete, and have not been forged, misrepresented, or fraudulently created to violate any law or commit immigration fraud. 
    3. You represent and warrant that you are not impersonating any person or entity. 


  8. Indemnity: You agree to indemnify and hold FilipinoVisa, its directors, employees, agents, contractors, officers, and assigns for any losses, costs, liabilities, and expenses, including reasonable attorney’s fees relating or arising out of your use of our service(s) including your breach of these Terms of Service, any agreement/contract you sign with us, any allegation that any material you submit were owned by a third party, or was created fraudulently in violation of the law.   

  9. Intellectual Property:
    1. Our website and its original content, features, and functionality are owned by Together Light Inc. and are protected by copyright, trademark, and other intellectual property or proprietary rights laws. 
    2. You shall not modify, reproduce, distribute, create derivative works of, publicly display, perform, republish, download, store, or transmit any of the material on our website, or while using our services. 


  10. Privacy:
    1. Any personal information (including sensitive personal information) you provide to us will be stored on our computers/servers. 
    2. If you are located outside the United States, please note that your information is being sent to the United States and the Philippines. By signing up for our services(s) you consent to your data being sent to the US and the Philippines, and to such third parties and jurisdictions as may be involved in the provision and operation of our service(s). 
    3. You also agree to read our Privacy Policy, which has more details on how your personal information is being used and processed. 


  11. Limitation of Liability:
    1. To the fullest extent permitted by the laws of New Hampshire (United States of America); we disclaim all guarantees, express or implied, including but not limited to guaranteeing any visa results, entry or exit from a port of entry or exit in the United States, or any other country in the world, any decision (approval or denials from any immigration authority in the United States, or anywhere else). 
    2. We shall not be liable for any tort, direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits, or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access or use of our website or service(s).
    3. We shall also not be liable for any loss of goodwill, loss of data, accuracy of results, or computer failure or malfunction. 
    4. We do not conduct background checks or otherwise screen persons registering for our service(s) in any way. Therefore, we cannot establish and do not attempt to establish whether users of our service(s) are who they claim to be. As a result, we will not be liable for any damages, direct or indirect, incidental or consequential, or punitive arising from using our service(s).
    5. We will also be liable if a user is using our service(s) to commit or attempt to commit immigration fraud.
    6. In any event, our liability shall be limited to the amount you have paid us for using our service(s).


  12.  Links to Third-Party Websites: Our website may contain links to third-party websites that are not owned or controlled by Filipino Visa. We have no control over and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Filipino Visa shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services. 

  13. Change to Terms: We reserve the right, at our sole discretion, to modify or replace these Terms of Use at any time. If a revision is material, we will try to provide at least 30 days' notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion.

  14. Governing Law: These Terms of Use shall be governed by and construed under the laws of New Hampshire (United States of America), without regard to its conflict of law provisions. 

  15. Dispute Resolution:
    1. In the event of a dispute arising related to the terms of this Terms of Service, the dispute shall be resolved by binding virtual arbitration. 
    2. The laws of New Hampshire, United States of America shall govern the arbitration. 
    3. The arbitrator shall be mutually appointed by the Parties, and paid for by the disputing Party. 
    4. If the Parties cannot agree on an arbitrator, an arbitrator shall be chosen at random from https://www.nhmediators.org/.
    5. The rules of arbitration shall be the Non-Administered Arbitration Rules listed under the CPR’s website as the most current at the time of the dispute. 
    6. Any ambiguity between the arbitration rules and these Terms of Service shall be resolved in favor of these Terms of Service. 
    7. The arbitration shall be conducted in English.


  16. Complaints:
    1. To resolve any complaints regarding our service(s), you should first contact our customer service department by clicking here and submitting a complaint to us under the “message” box.
    2. If you have paid for using our service(s) and subsequently are not satisfied or have a dispute regarding the service(s) rendered, you agree to contact us directly before disputing the charge with your bank/credit card company.
    3. If you dispute a charge with your bank without contacting us first, we have records demonstrating work done on your account that will be provided to your bank and credit collection agencies.
    4. If your complaint is not resolved or settled with us, you agree to resolve any dispute related to these Terms of Service as per the Dispute Resolution clause given above (clause 15) under these Terms of Service. 


  17. Miscellaneous:
    1. You consent to receive electronic communications and/or phone calls from us related to your visa application/document preparation work. 
    2. You cannot assign your rights and obligations under these Terms of Service without our written consent. 
    3. Any waiver of a breach of these Terms of Service will not be interpreted as a waiver of any subsequent breach. 
    4. If any provisions of these Terms of Service are held to be invalid or unenforceable for any reason, the remaining provisions will continue to be valid and enforceable without being impaired or invalidated.
    5. These Terms of Service and any contract/agreement you sign with us, constitute the entire understanding between you and FilipinoVisa and supersede any and all oral understandings between you and us.
